Event Waiver & Liability Release

This Event Waiver & Liability Release ("Waiver") applies to all events organized, hosted, or sponsored by NOTOXIC® Universe, including but not limited to workshops, meetups, conferences, community gatherings, online events, and any related activities.

IMPORTANT:By registering for, attending, or participating in any NOTOXIC® Universe event, you (the "Participant") acknowledge that you have read, understood, and voluntarily agree to be bound by this Waiver. If you do not agree to these terms, you must not participate in the event.

This Waiver is a legally binding document. Please read it carefully before participating in any event.

1. Event Registration and Participation

1.1 Registration Requirements

To participate in events:

• Complete event registration (if required)
• Provide accurate registration information
• Meet eligibility requirements (age, membership, etc.)
• Pay registration fees (if applicable)
• Agree to this Waiver and event terms

1.2 Event Conduct and Behavior

Participants agree to:

• Follow Rules: Follow all event rules, guidelines, and instructions
• Respect Others: Respect other participants, staff, volunteers, and venue personnel
• Venue Compliance: Comply with venue policies, rules, and regulations
• Prohibited Behavior: Refrain from disruptive, harmful, illegal, or inappropriate behavior
• Community Guidelines: Comply with Community Guidelines
• Safety Instructions: Follow all safety instructions and procedures

1.3 Removal from Event

NOTOXIC® Universe reserves the right to remove participants who:

• Violate event rules or Community Guidelines
• Engage in disruptive or harmful behavior
• Pose a safety risk to themselves or others
• Violate venue policies

Removed participants are not entitled to refunds and may be banned from future events.

2. Acknowledgment of Risks and Safety Disclaimers

2.1 Acknowledgment of Risks

YOU ACKNOWLEDGE AND UNDERSTAND that participation in events may involve inherent risks, including but not limited to:

• Physical Risks: Risk of physical injury, including slips, falls, collisions, or accidents
• Health Risks: Risk of illness, allergic reactions, or health complications
• Property Damage: Risk of damage to personal property or belongings
• Environmental Risks: Risks associated with weather, venue conditions, or environmental factors
• Third-Party Risks: Risks from actions or negligence of other participants, third parties, or venue operators
• Activity-Specific Risks: Risks specific to event activities (workshops, demonstrations, physical activities, etc.)

2.2 Assumption of Risk

YOU VOLUNTARILY ASSUME ALL RISKS associated with event participation, whether known or unknown, including risks that may result from negligence of NOTOXIC® Universe, event organizers, venue operators, or other participants.

2.3 Safety Disclaimers

NOTOXIC® Universe:

• Takes reasonable precautions to ensure event safety
• Provides safety instructions and guidelines
• Maintains appropriate insurance coverage
• Cannot guarantee absolute safety or prevent all accidents

2.4 Participant Responsibilities

Participants are responsible for:

• Assessing their own physical and mental fitness to participate
• Disclosing any medical conditions, allergies, or limitations that may affect participation
• Following all safety instructions and guidelines
• Using equipment and facilities safely and appropriately
• Taking reasonable care for their own safety and the safety of others

3. Liability Release and Waiver

3.1 Release of Liability

YOU HEREBY RELEASE, WAIVE, AND DISCHARGENOTOXIC® Universe, its affiliates, officers, directors, employees, volunteers, agents, and representatives (collectively, "Released Parties") from any and all claims, demands, causes of action, damages, losses, costs, or expenses (including legal fees) arising from or related to:

• Personal injury, illness, or death
• Property damage or loss
• Accidents or incidents during events
• Negligence of Released Parties (except gross negligence or willful misconduct)
• Actions or negligence of other participants or third parties
• Venue conditions or third-party services

3.2 Waiver of Claims

YOU WAIVE any right to bring claims, lawsuits, or legal actions against Released Parties for any injury, damage, or loss arising from event participation, except for claims arising from gross negligence or willful misconduct.

3.3 Limitation of Liability

To the maximum extent permitted by law:

• NOTOXIC® Universe liability is limited to the amount paid for event registration
• NOTOXIC® Universe is not liable for indirect, consequential, or special damages
• NOTOXIC® Universe is not liable for third-party actions or services

3.4 Indemnification

YOU AGREE TO INDEMNIFY AND HOLD HARMLESS Released Parties from any claims, damages, or expenses arising from:

• Your participation in the event
• Your violation of event rules or this Waiver
• Your actions or negligence that cause injury or damage to others
• Your violation of any laws or regulations

4. Photography, Videography, and Media Consent

4.1 Consent to Photography and Recording

By participating in events, you consent to:

• Photography: Being photographed during events by NOTOXIC® Universe or authorized photographers
• Videography: Being recorded on video during events
• Audio Recording: Being recorded on audio (for workshops, presentations, etc.)
• Live Streaming: Being included in live streams or broadcasts (where applicable)

4.2 Usage Rights

NOTOXIC® Universe may use images, videos, and recordings for:

• Marketing and promotional materials
• Social media and online platforms
• Website and advertising
• Press releases and media
• Educational and training purposes
• Documentation of events

4.3 Opt-Out Rights

You may opt out of photography/recording by:

• Notifying event staff at registration or before the event
• Wearing a provided opt-out identifier (badge, sticker, etc.)
• Positioning yourself outside of photography areas (where possible)

Note: Opting out may limit your participation in certain event activities or areas where photography is integral to the event.

4.4 Participant Photography

Participants may take photos/videos for personal use, subject to:

• Respecting others' privacy and consent
• Not disrupting event activities
• Not using images for commercial purposes without permission
• Compliance with venue policies

5. Medical and Emergency Procedures

5.1 Medical Conditions

Participants must:

• Disclose any medical conditions, allergies, or limitations that may affect participation
• Bring necessary medications or medical devices
• Inform event staff of any medical emergencies or concerns
• Assess their fitness to participate in event activities

5.2 Emergency Medical Treatment

In case of medical emergency:

• Event staff will seek emergency medical assistance
• You consent to emergency medical treatment if you are unable to consent
• You are responsible for all medical costs and expenses
• NOTOXIC® Universe is not responsible for medical decisions or treatment

5.3 Emergency Contacts

Participants should:

• Provide emergency contact information during registration
• Update contact information if it changes
• Carry identification and emergency contact information

6. Property and Personal Belongings

6.1 Personal Property

Participants are responsible for:

• Safeguarding their personal belongings and property
• Not bringing valuable items unless necessary
• Using provided storage facilities (if available)
• Reporting lost or stolen items to event staff

6.2 Property Damage

NOTOXIC® Universe is not liable for:

• Loss, theft, or damage to personal property
• Damage to vehicles or belongings left at venue
• Loss of personal items during event activities

6.3 Venue Property

Participants are responsible for:

• Not damaging venue property or equipment
• Paying for any damage caused to venue or NOTOXIC® Universe property
• Using equipment and facilities appropriately

7. Event Cancellation and Modifications

7.1 Event Cancellation by NOTOXIC® Universe

NOTOXIC® Universe may cancel or modify events due to:

• Weather conditions or natural disasters
• Safety concerns or emergencies
• Venue unavailability or issues
• Low registration or operational reasons
• Force majeure events

7.2 Refund Policy

If event is canceled:

• Full Refund: Full refund of registration fees (if paid)
• Alternative: Option to transfer registration to rescheduled event
• No Additional Liability: NOTOXIC® Universe is not liable for travel, accommodation, or other expenses

7.3 Event Modifications

NOTOXIC® Universe reserves the right to:

• Modify event schedule, activities, or format
• Change venue or location
• Substitute speakers, presenters, or activities
• Modify event content or agenda

Participants will be notified of significant modifications. No refunds for minor modifications.

7.4 Participant Cancellation

If you cancel your participation:

• Refund Terms: Refund terms are specified in event registration (typically no refunds within 7 days of event)
• Transfer: Registration may be transferable to another person (subject to approval)
• No Show: No refunds for no-shows

8. Insurance

8.1 NOTOXIC® Universe Insurance

NOTOXIC® Universe maintains:

• General liability insurance for events
• Insurance coverage as required by law and venue requirements

8.2 Participant Insurance

Participants are encouraged to:

• Maintain personal health and accident insurance
• Consider travel insurance for events requiring travel
• Ensure adequate coverage for personal property

NOTOXIC® Universe insurance does not cover participant injuries, losses, or damages.

9. Governing Law and Dispute Resolution

9.1 Governing Law

This Waiver is governed by:

• Laws of India
• Jurisdiction of courts in Chennai

9.2 Dispute Resolution

Disputes will be resolved through:

• Good faith negotiation
• Mediation (if applicable)
• Arbitration or litigation as per applicable laws

9.3 Severability

If any provision of this Waiver is found invalid or unenforceable:

• The remaining provisions remain in full effect
• The invalid provision is modified to the extent necessary to be enforceable
